Terms of Service

By accessing and using DealerOneView ("Service"), you accept and agree to be bound by the terms and provisions of this agreement. This agreement is governed by the laws of the jurisdiction in which your dealership operates (United States or Canada).

DealerOneView provides a comprehensive dealership management system including but not limited to:

• Customer relationship management (CRM)
• Inventory management
• Sales and order processing
• Marketing and campaign tools
• Reporting and analytics

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years of age or the age of majority in your state or province
• Represent a legitimate automotive dealership business
• Notify us immediately of any unauthorized account access

Subscription terms:

• Subscriptions are billed monthly or annually as selected
• Fees are charged in USD or CAD based on your billing location
• Payments are processed on the anniversary of your subscription start date
• Failed payments may result in service suspension
• Refunds are provided in accordance with our refund policy
• Prices may change with 30 days notice to existing subscribers

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to systems or data
• Upload malicious code or viruses
• Reverse engineer, decompile, or disassemble the software
• Resell or redistribute the Service without authorization
• Use the Service to send spam or unsolicited communications
• Violate any applicable federal, state, or provincial laws in the US or Canada

Your Data: You retain ownership of all data you enter into the Service. We do not claim ownership of your customer data, inventory data, or business information.

Our Rights: You grant us a limited license to process your data to provide the Service. This includes storing, backing up, and analyzing data for service improvement.

Privacy Compliance: We process all personal data in accordance with applicable North American privacy laws, including CCPA (California), US state privacy laws, PIPEDA (Canada), and Quebec Law 25. See our Privacy Policy for details.

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance when possible. We are not liable for service interruptions due to factors beyond our control.

To the maximum extent permitted by applicable law, DealerOneView shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunities
• Data loss (you are responsible for maintaining backups)
• Third-party actions or integrations

Our total liability is limited to the amount you paid in the 12 months prior to the claim.

Your Rights: You may cancel your subscription at any time. Upon cancellation, you will have access until the end of your billing period.

Our Rights: We may suspend or terminate accounts that violate these terms, fail to pay, or pose a security risk. We will provide reasonable notice when possible.

Data Export: Upon termination, you have 30 days to export your data. After 30 days, data may be permanently deleted.

These Terms are governed by the laws of the jurisdiction in which your dealership is located (state for US dealers, province for Canadian dealers). Any disputes will be resolved in the courts of that jurisdiction. Both parties agree to first attempt resolution through good-faith negotiation before pursuing legal action.

We may modify these Terms from time to time. Material changes will be communicated via email and/or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the new Terms.
